Election Tribunal Orders Re-trial Of House Of Reps Case Between Onjeh(ACN) And Saleh Hassan(PDP).
The Appeal Court in Makurdi, the Benue state capital, north central Nigeria, has ordered a re-trial of the House of Representatives case between the former President of National Association of Nigerian Students, NANS, Daniel Onje of the Action Congress of Nigeria, ACN, candidate and Hon. Hassan Saleh of PDP.
In his ruling, weekend, Justice Uchechukwu Onyemenam faulted the ruling of the lower court wherein it held that the matter was a pre-election one.
She maintained that the judgment was a nullity while setting it aside and ordered for the constitution of a new panel to hear the matter again on its merit.
The Justice Anselm Nwaigwe-led panel in its judgment on 16 September, 2011 had ruled that the issue of qualification complained about by Daniel Onje was a pre-election matter, adding that they lacked jurisdiction to entertain the case.
Onje, the former NANS president, objected to the judgment and appealed against it on three grounds.
He insisted that Saleh was not the PDP candidate as at the time of the election.
Onje also demanded that the 56,739 votes scored by the House of Representatives candidate be deemed as wasted and urged the court to declare him the duly elected member of the House of Representatives For Adikpo/Okpokwu/ Ogbadibo Federal constituency.
In his reaction to weekend’s judgment, the former NANS President expressed gratitude to God and the Appeal Court for the sound judgment, expressing confidence that he would emerge victorious when the case is retried.
“I have documentary and oral evidences to win the case this second time,” Onje said.
