FOR THOSE QUEUING BEHIND OSHIOMOLE TO AGITATE FOR SARAKI’s IMPEACHMENT

There is NO LAW that states that Saraki must “belong to the ruling party” or “belong to the majority party” before he must retain his position as the President of the Senate.

Section 50 (2) of the Constitution states: “The President or Deputy President of the Senate or the Speaker or Deputy Speaker of the House of Representatives shall vacate his office:

a) If he ceases to be a member of the Senate or of the House of Representatives, as the case may be, otherwise than by reason of a dissolution of the Senate or the House of Representatives; or

b) When the House of which he was a member first sits after any dissolution of that House; or

c) If removed from office by a resolution of the Senate or the House of Representatives, as the case may be, BY THE VOTES OF NOT LESS THAN TWO THIRD majority of the members of the House.

According to the constitution, Saraki remains president oSection 50 (2) of the Constitution states: “The President or Deputy President of the Senate or the Speaker or Deputy Speaker of the House of Representatives shall vacate his office:

a) If he ceases to be a member of the Senate or of the House of Representatives, as the case may be, otherwise than by reason of a dissolution of the Senate or the House of Representatives; or

b) When the House of which he was a member first sits after any dissolution of that House; or

c) If removed from office by a resolution of the Senate or the House of Representatives, as the case may be, BY THE VOTES OF NOT LESS THAN TWO THIRD majority of the members of the House.

Forget Oshiomole’s rabble rousing!

The only way Saraki can be impeached CONSTITUTIONALLY is if

the APC can rally 2/3 majority of Senators— this means 73 senators are required to impeach Saraki as it remains.

So, no matter how the APC Senators try, they would need some PDP senators to joint them to impeach Saraki.

Until this happens... Oshiomole only would keep rambling!

And by the way, Saraki is NOT the first leader from the National Assembly that would come from neither the ruling party nor the majority party!

We had late Edwin Ume-Ezeoke as the Speaker of the House of Representatives in the 2nd Republic.

Ume-Ezeoke was from the Nigeria Peoples Party (NPP); whereas the majority party was the ruling party— the National Party of Nigeria (NPN).

Then, we had Aminu Tambuwal who retained his position as the Speaker of the House of Representatives after defecting from the PDP to the APC in 2014.

The constitution states THE SAME LAW for the removal of The Senate President, the Senate Deputy President, the Speaker of the House of Representatives, and the Deputy Speaker of the House of Representatives!

It therefore ridiculous that the ruling party ignores that while in the minority,

Ike Ekweremadu of the PDP

had been the Deputy Senate President, and it is ONLY AFTER Saraki “angered” the APC underlords that they keep threatening Saraki’s impeachment, howbeit unconstitutionally!

We saw them try it in Benue.

We saw them try it by laying siege to Saraki’s convoy in his residence some weeks ago.

We saw them try it with the failed National Assembly siege, where Lawan Daura became the fall-guy.

Oshiomole should be cautioned to give up his obsession and desperate agitation for Saraki’s impeachment, knowing fully well that the Senators he can rally to do this job cannot make up to 73 in number.

Anything less is the APC calling for anarchy!
