A scumbag California man who knowingly infected 24 other men with HIV may only be sentenced to a maximum of 6 months in prison if the charges aren’t upgraded to a felony.

The San Diego City Attorney’s Office has charged Thomas Guerra, 29, for knowingly exposing an ex-boyfriend to HIV, who is now testing positive. After Guerra’s ex filed a report with police, Guerra has been accused of infecting 24 other men with HIV.
Guerra’s first, unnamed accuser told the San Diego ABC affiliate 10News that he had been dating Guerra for a year and in a matter of hours before a planned proposal, was messaged by a man on Facebook claiming to be an ex of Guerra’s who told him of his positive status.

“I don’t even know who I was living with. I don’t know who I had fallen in love with,” the man told 10News. “There are many people who are being hurt and could potentially still be hurt. It needs to stop.”
The man also told CBS8 that he discovered a number of text messages on Guerra’s phone allegedly implicating him.

“Texts where he’s stating he’s negative to people then bragging to others about giving people his ‘positive load,'” he told CBS8. “It’s crude, it’s…I don’t know how someone could treat another individual like that.”

Guerra, who is also known as Ashton Chavez, currently faces a maximum of six months in prison and a $1,000 fine.
The alleged victim has provided San Diego police with additional text messaging records that he hopes could prompt prosecutors to upgrade the case to a felony, punishable by up to eight years in prison.
Upgrading this charge to a felony should be a no-brainer, especially given all the other nonsense people get sentenced to YEARS in prison for!
