Makurdi High Court Judge Disqualifies Himself From Hearing Ugba's CaseAgainst APC.










Makurdi High Court Judge, Justice Adam Onum, on Tuesday disqualified himself from hearing the suit filed by Prof Steve Ugba, against the All Progressive Congress (APC) Electoral Committee in Benue.
Ugba, one of the governorship aspirants, had filed an exparte motion before the court, seeking to restrain the party from holding its scheduled primaries in the state.


In his motion dated Dec. 5, 2014, Ugba complained of being excluded from the primaries, and want the court “to maintain the status quo, pending the outcome of the substantive suit.’’
In his ruling, the judge upheld Ugba’s prayer, as there was nothing before him to show that the clearance granted the applicant by the party was withdrawn.

"In the circumstance, I see profound merit in the interim order sought to restrain the respondents from conducting the party primaries scheduled to hold on Friday, Dec.5."
He therefore, ordered that the party put the scheduled primaries on hold and adjourned the matter to Dec. 9, 2014 for the hearing of the substantive suit.
However, when the case came up for hearing on Tuesday, Dec. 9, Onum referred the case back to the Chief Judge of Benue, Justice Iorhemen Hwande, on the ``ground of personal reasons.’’
