Nursery Owner Ordered To Pay £16,500 After A 2 Year Old Boy Fell From 12ft Open Window.





A nursery owner has been ordered to pay £16,500 after a two-year-old boy fell 12ft from an open window.Billy Coniff only survived the horror fall because he somersaulted in mid-air and avoided hitting the pavement head-first and instead landed on his feet.
A court heard Billy climbed onto a toy cot and a radiator cover to get onto the sill before he fell 12ft to the pavement below.

Two members of staff were present at the time but were supervising children at the other end of the room. A court heard Billy escaped with only minor injuries.

Billy's mum Kerrie Coniff, 36, said Munchkins Day Nursery in Shard End, Birmingham, should be shut down after the fall on September 23 2013.

Today, boss Suzanne Holmes, 62, of Solihull, West Midland, admitted failing to discharge her duties under the Health and Safety at Work Act 1974.

She was fined £2,500 and ordered to pay £14,000 costs at Birmingham Crown Court.

Sentencing her, Judge Roderick Henderson said: 'It requires no imagination at all to realise how serious this could have been, had the child fallen head-first on to concrete slabs directly underneath the window.

'There was some delay before staff realised what had happened. That demonstrates a lack of supervision by them at the time.'
The judge said the boy suffered night terrors after his ordeal while his parents had experienced 'enormous distress'.
