The battle for the governorship ticket of the Peoples Democratic Party (PDP) in Borno State has shifted to the Federal High Court in Abuja.
The winner of the party's governorship primaries, Gambo Lawan, has asked the court to compel the Independent National Electoral Commission (INEC) to put his name on the ballot.
He also asked the court to declare that the forwarding of any other name by the PDP to INEC other than his own for the purpose of the governorship election in Borno State is illegal, unlawful, unconstitutional, null and void and of no effect whatsoever.
Lawan is also seeking a court order to pronounce him as the candidate and not one Alhaji Mohammed Imam whose name has already been forwarded to the INEC as PDP flag bearer.
In the suit marked FHC/ABJ/CS/1123/2014 and filed by Marcel Oru, the Plaintiff, Lawan, is asking for a court order prohibiting Imam from parading or further parading himself as the governorship candidate.
Apart from Mohammed Imam, other defendants in the suit are PDP and INEC.
The plaintiff, who was a former National Chairman of Grassroots Democratic Movement (GDM) under the late Sani Abacha, also wants the Court to give order of perpetual injunction stopping PDP and INEC from recogniSing and dealing with Imam as the governorship candidate.
Besides, the plaintiff asked for another court order directing PDP and INEC to take step to list his name as the governorship candidate and forward same to INEC for the purpose of governorship election.
