Mutiny: Human Rights Lawyer Chief Femi Falana Urges Army Council To Commute Death Sentence To Imprisonment.

Renowned constitutional lawyer and
human rights activist, Chief Femi Falana(SAN) yesterday implored the Army Council to commute the death sentence passed on 12 soldiers by the General Court Martial to imprisonment instead of confirming it.

According to him, while the soldiers
were erroneously charged under
section 52(1) of the Armed Forces Act
Cap A20 because the General Officer
Commanding whose car was shot at was not killed, they were charged with
attempted murder which does not
attract the death penalty.

In its judgement on Monday, the
General Court Martial which tried the
group of 18 soldiers for act of mutiny in
Maiduguri, Borno State on May 14, 2014 discharged and acquitted five of the soldiers, jailed one for 28 days and
convicted the remaining 12 and
sentenced them death, after finding
them guilty of criminal conspiracy,
mutiny, attempt to commit murder,
insubordination to a particular order
and false accusation.

But in a statement he issued yesterday
evening, Falana noted that in the
interest of justice, the facts and
circumstance of the mutinous act of the
convicted soldiers should be taken into
consideration.

He also advised the 12 condemned
soldiers that should the decision in the
case is confirmed by the Army Council,
the convicted soldiers should take the
case to the Court of Appeal which is
likely to follow its decision in a similar
case.

“While mutiny cannot be condoned by
the armed forces because it strikes at
the foundation of discipline in the
military it ought to be pointed out that
the 18 soldiers were erroneously
charged under section 52(1) of the
Armed Forces Act Cap A20 Laws of the
Federation of Nigeria, 2004.
Fortunately, the General Officer
Commanding whose car was shot at was not killed. Hence, the soldiers were
charged with attempted murder which
does not attract the death penalty”, he
noted.

Accordingly, the legal luminary pointed
out that the 12 convicts should have
been charged under section 52(2) of the
Armed Forces Act which provides for
life imprisonment, just like in the case
of the Akure 27 in which the convicted
soldiers were equally charged with
mutiny but convicted and sentenced to
life imprisonment.

He said, “Before the incident the
soldiers at the Maimalari cantonment
had complained of insufficient
ammunition, food and allowances. The
visit of the GOC was said to have
coincided with the arrival of the corpses
of soldiers killed in an ambush in
Chibok on the night of May 13, 2014. It
was the tragic situation which
reportedly infuriated the soldiers.
Having investigated and confirmed the
circumstances which led to the mutiny
in question the military authorities
removed the GOC.

“In the light of the foregoing, we urge
the Army Council not to confirm the
death sentence passed on the 12 soldiers but commute same to imprisonment in the interest of Justice. The facts and circumstance of the mutinous act of the convicted soldiers should be taken into consideration”.
Falana noted further that in the case of
Akure 27, the Army Council reduced the
sentence of life imprisonment to 7 years and later pardoned the convicts after taking into cognizance the fact that the allowances of the convicts who had served in Liberia were diverted by some military officers.

Advising the soldiers to appeal is their
sentence is not commuted, he said,
“However, if the death sentence of the
Maiduguri 12 is confirmed by the Army
Council the convicted soldiers are
advised to take the case to the Court of
Appeal which is likely to follow its
decision in the case of Yussuf & 21 Ors v Nigerian Army (2003) 36 WRN 68
wherein the sentence of life imprisonment passed on the appellants
who had rioted at the Cairo Airport in
Egypt was quashed.
“It was the finding of the Court that the
offense of mutiny complained of by the
respondent was instigated by the
officers who had diverted the medical
allowances which ought to have been
paid to the convicts while receiving
medical treatment in Egypt.” He further
advised.

President Of Rwandan Senate Resigns After Being Accused Incompetence.

The President of the Rwandan Senate, Jean-Damascene Ntawukuriryayo, resigned on Wednesday after he was accused of incompetence.
He was succeeded by his deputy, Bernard Makuza.
Ntawukuriryayo cited personal reasons for the decision to stand down.
He resigned after senators accused him of creating administrative blockages in the upper house of parliament, and of illegally hiring staff.
Ntawukuriryayo heads the Social Democratic Party, the country’s second-biggest party, which is in a coalition government with President Paul Kagame‘s Rwandan Patriotic

in July. Habumuremyi has denied allegations that he had connections with the Congo-based rebel
movement Democratic Forces for the Liberation of Rwanda which has staged attacks in Rwanda.

Senate President's Media Office Calls Out Daily Trust Newspaper For Misquoting The President Of The Senate On 2015 Elections.

The Media Assistant to the Senate President Mr Paul Mumeh has reacted to a false publication by the DailyTrust Newspaper where The SP was quoted to have said 2015 elections is not on the table.
His release came to news desk this evening,Read the Press Release below.

Our attention has been drawn to the lead story of the Daily Trust of Wednesday, September 17, 2014, where in the President of the Senate, Senator David Mark was quoted to have said 2015 Elections not on the table.

For the avoidance of doubts, the President of the Senate, Senator David Mark made the following remarks in closing the Senate Debate on the motion titled; Threat to the National Sovereignty and Territorial Integrity of Nigeria by Insurgents. He said: "At this stage, all of us are involved whether you are in uniform or out of uniform and we have to find a solution to it ( Boko Haram).

We should back the military, mobilize as much as we can and bring all our war resources and efforts together so that we can prosecute this war. There is no way in which we can say that this (Boko Haram) is exclusively for one section of the country. "Unfortunately, we are not satisfied with the way the war has been prosecuted so far. We want a better strategy and precise statement that will give direction on how we are going to prosecute this war and end it as quickly as possible. It is not a question of election because election is not even on the table now.""I would want us in the process of looking at the prayers (of the motion) take those that will assist us to prosecute this war.

I agree with all of you that we are in the state of war and what is happening now is a challenge even to our legitimacy in this chamber".From the foregoing, it is clear that Senator Mark did NOT call and will NEVER call for the postponement of the 2015 general elections. Rather, he has emphasized the danger which Boko Haram portends to our nation and only explained that the issue before the Senate now was not election matters but how to end the Boko Haram war against Nigerians.Senator Mark's position, which is unequivocal, is that we must as a people stand together to fight Boko Haram and return our nation to the path of peace and unity. It is curious and strange that among the arrays of national newspapers, only Turaki A. Hassan of the Daily Trust manufactured his own story to suit the whims and caprices of his masters. We challenge Turaki to produce the verbatim recording of the remarks he ascribed to Senator Mark.It is imperative to make this clarification before readers take away erroneous impression which this reporter has created.

Alhaji Abubakar Usman has formally led Mike Gbasha,Joe Wayas and his supporters to join the Accord Party (AP).
In a brief ceremony held at the party’s
secretariat in Makurdi Usman, popularly referred to as, ‘Young Alhaji’ said what makes a party tick is its content and not the name it
bears. The move has finally put paid to months of speculation that he was in secret talks with the leaders of Peoples Democratic Party (PDP) in
the state having earlier dumped the APC in May this year following the rivalry between him and the Senate minority leader, George Akume.
Abubakar in an interview with newsmen shortly after he was received by his Accord Party officials explained that the party provides a platform for people’s view to be recognised instead of name calling that was the order in his former party, adding that it was the ideals of
the new party that attracted political heavy weight such as Ambassador Mike Gbasha, Joe Waya and himself.
Usman maintained that he remains a beautiful bride that does not need to go in search of a husband as both the APC and PDP are still wooing him.
“I’m now married to Accord Party. I’m still open to talks, if PDP or APC can convince me that Accord is not good for me, then I will divorce but I will not commit adultery. APC have been
approaching me, PDP have also been
approaching me but I have found a man (AP) who thinks I can make a good wife,” he said.
