ABUSE OF HUMAN RIGHTS: Legal Practitioner writes NBA over Mr Stephen Nyitse.

A legal practitioner from Benue state ,Barrister Reuben Acka has written a letter to the Gboko branch of NBA on the Abuse Of Human Rights of Mr Stephen Nyitse,the man who sat on the new Tor Tiv's chair before his coronation.Please the letter

RE: MR STEPHEN NYITSE’S ISSUE

The Nigerian Bar Association Gboko branch Chairman may wish to note that, The Tor Tiv V, Orchivirigh Professor James Ortese Iorzua Ayatse was Coronated in Gboko on Saturday the 4th of March,2017 at the J.S. Tarka stadium.

Mr. Stephen Nyitse, a male of 30 years old was alleged to have walked pass the heavy Security cordon and sat on the Tor Tiv V’s throne shortly before the Tor Tiv V was Coronated.

The Security Personnel on duty in the J.S. Tarka stadium that day promptly apprehended Mr. Stephen Nyitse brutalized him mercilessly, interrogated him in the stadium without a counsel of his choice or one appointed by the state, forcefully arrested him and took him to the police station and continued with their interrogation all through without a counsel of his own nor one appointed by the state.

Mr. Stephen Nyitse was taken to the Chief magistrate Court Gboko Presided over by Mr. P.S. Chaha without a Counsel of his own nor one appointed by the state on Monday 6th of March 2017, more than 24 hours after the said arrest.

It is not clear as of now what charges is offences Mr. Stephen Nyitse was charged with at the Chief Magistrate Court and why he was summarily tried and sentenced to Four Years in Presentment.

The Reuben Acka Foundation CAC/IT/NO75961 is an Incorporated foundation amongst which aims is to fight for the abuse of Human Rights of Indigent Nigerians in the mould of Mr. Stephen Nyitse.

It is in view of the above that the Foundation is applying to the NBA, Gboko Branch to take up the pursuit of the constitutionally guaranteed fundamental Human Rights of Mr. Stephen Nyitse and ensure that these rights are not breached or threatened to be abused.

The Reuben Acka Foundation CAC/IT/NO75961 feels strongly that if Mr. Stephen Nyitse breached any written Law at all, he should have been accorded his right of counsel to represent him and adequately prepare and defend his case. This was neither done at the police station where he was detained for more than 24 hours nor at the Chief Magistrate Court where he was charged, tried and sentenced and driven straight to Gboko Prison within one hour.

The Reuben Acka Foundation CAC/IT/NO75961 feels that Mr Stephen Nyitse is being unfairly treated and NBA Gboko should step in to correct this.

The Foundation feels that there are many traditional ways of handling such issues as Mr Stephen Nyitse was accused of like:

Inviting his parents to come before the Tor Tiv to determine his
state of health.
Instituting a medical team by the Tor Tiv to determine Stephen
Nyitse’s state of health.

If found to be defective, then
Taking care of him and caring for him by the Tor Tiv V and or any other such measure as are appropriate but to the general welfare of Mr. Stephen Nyitse in the spirit of goodwill and good fatherliness which The Tor Tiv V’s acceptance speech embodied.

To summarily charge, try, convict, sentence and imprison mr Stephen Nyitse in the manner the Chief magistrate did negates not only fundamental and basic principles of Law but it’s a travesty of Justice and must be redressed.

The above necessitated a letter of Appeal to the NBA, Gboko branch by the Foundation to wade into this matter that may turn out to be a national disaster for the Tor Tive V and the Tiv Nation generally.

The NBA, Gboko Chairman and the Branch generally should please accept the assuarances of our highest esteem.

The coronation of the fifth Tor Tiv, Professor James Ayatse, held on Saturday, at J. S. Tarka stadium, Gboko, Benue State.
His Royal Majesty ,Orchivirigh Prof James Ortese Ayatse  an indigene of Mbakan, Shangev- Ya, Kwande Local Government Area of Benue State. He was born on the May 12th, 1956 to the family of late Iorzua Ayatse and Mrs Adeior Iorzua ( nee Achaa, Mbarumun, nanev).

He attended LGEA school, Orbiam, ikov, Ushongo LGA : LGEA school, Mbagbegba, Shangev - Ya and St Anne's primary school, Adikpo where he obtained the first school leaving certificate. He attended and passed out with a WASC, division one certificate at Government secondary school Gboko. Armed with the excellent WASC certificate. 

His Royal Majesty proceeded to the prestigious University of Ibadan and graduated with a BSc Biochemistry, he was the best graduating student in the department. He thereafter obtained his MSc at the University of calabar where he passed out as the best graduating student. Prof. Moved to the university of Surrey, England as a commonwealth student for his PhD in Biochemistry. 

He returned to University calabar for his MBA.
HRM  has had a sterling career in academics and educational management. He started his career in 1980 as a graduate assistant in the university of Calabar and rose steadily and rapidly in the university system to attain the highest rank of a professor of Biochemistry in 1993.
HRM rose to the rank of Professor in 1993 in his thirties, becoming the first ever and perhaps still the only professor of Biochemistry of Tiv extraction.

He has held virtually all important positions in the university. He has taught at the university of calabar, University of Uyo, Benue state University University of Agriculture Makurdi, University of Abuja and Federal University Dutsin-Ma.
HRM has taught Biochemistry, Business Management and public administration to different groups of students and produced several BSc, MSc, MBA, MPA, and PhD.
> He has served as external Assessor for professional appointments /promotions and external examiner to several universities.
> He has chaired the national universities commission committees on performance indicators and minimum bench mark for science programmes for Nigerian Universities.
> He has chaired several panels for the accreditation of science programmes in Nigerian Universities.
> He has also served in the capacity of chairman or member of of several communities or governing boards at international, National and state levels.
> On three different occasions he was involved in formulation of the vision and blueprint for the development of Benue State.
> He served as chairman of the visitation panel to the Benue state University.
He has numerous scholarly publication in both reputable national and international journals.
HRM is the only Tiv man who has served as as Vice chancellor of two federal universities in Nigeria namely :
¡. Federal University of Agriculture Makurdi in 2001 - 2006
¡¡. Federal university Dutsin-Ma in Katsina State. 2011 - 2016.


At the University of Agriculture Makurdi, a once restive University. HRM used his sagacity and astuteness to restore peace and stability. He eradicated the menace of staff union strikes and violent students' demonstrations. All through his tenure there was no strike nor student demonstrations arising from internal problems.
He inherited gigantic debts, but paid all of them and left a healthy balance for the institution. 

There was massive and rapid expansion of the University which led to the establishment of various new departments and colleges and the students population soared from the below 2000 he inherited in 2001 to about 7000 before the expiration of his tenure.

As vice chancellor of the Federal University Dutsin-Ma, prof Ayatse brought his experience to bear on the newly established university. He was the first vice chancellor out of the Nine federal universities established at the time to graduate students and mobilize them for the mandatory NYSC. He also conducted the first ever convocation of the university before completing his tenure.

He laid a sturdy foundation for an ICT driven university with computerized and online services. In January 2015 and 2016, webometric, world Ranking of universities rated Federal University Dutsin-Ma as the 14th Best university in Nigeria ahead of many older institutions.
He was a member of the governing Council of the National Youth Service Corp and later Michael Okpara University, Umuidike.
In all the position he has held, he has used them for the good of humanity. He has facilitated the employment of several Tiv sons in universities and other establishments.
HRM  is intelligent, hard working, self motivated, focused, result and , achievement oriented.
He is God fearing, trustworthy, reliable, resourceful, dependable honest,and disciplined with a high level of integrity.

He is an excellent planner, organized and frugal: an efficient manager of human and material resource.
