Reps divided over $1bn insurgency fund


Members of the lower legislative chamber of the national assembly were divided on Thursday over a motion to deduct 13 percent derivation from the $1 billion approved for the fight against insurgency and general security in the country.


The bill, introduced by Ken Chikere, from Rivers state, seeks to ensure that the 13 percent derivation is given to oil-producing states in the country.

Last year, governors approved that the $1 billion should be taken from the excess crude account (ECA) to help in the fight against insurgency and as well as for security purposes.

While introducing the motion, Chikere said even though the money should be deducted and given to the states in accordance to the section 162 (2) of the 1999 constitution “as benefits” payable to them, such had not been done.

He added that the money, if not paid to the states, “would amount to double contribution from the said states” in the war against insurgency and also a breach of section 162(2) of the constitution as well as section 1 of the Allocation Revenue (federation account) Act.

However, while some of the lawmakers agreed that the 13 percent derivation should be deducted, others argued that the excess crude account in question is not subject to such provision as contained in the constitution.

Some also asked if such withdrawal is subject to the approval of the national assembly.

Contributing to the motion, Henry Achibong from Akwa Ibom asked: “This money being used to fight insurgency, has it been approved by the national assembly?

“Is it meant for states or for the federal government or for the entire federation? If it is for the entire country, then it is subjected to the approval of the national assembly.”


Yisa Orker-jev, chairman of the house committee on rules and businesses, described the motion as “speculative as it is not yet clear the tier of government and the account the fund belongs to”.

“The best thing to do in this case is to assign the committee on finance to study this and know what is in the excess crude account, what belongs to each tier of government and what should be done,” he also said.

Also speaking, Yusuf Lasun, deputy speaker of the house, said while the bill is relevant, the lawmakers should take cognisance of the fact that “Boko Haram is real and we have suffered a lot from it”.

He said: “This motion touches the heart of our constitution but we have not been able to differentiate between federation account and consolidated account. And that is a major problem.

“So we should sit down and study the issues involved well before we take any action on this.”
Commenting on the motion, Yakubu Dogara, speaker of the house, said the lawmakers should be more concerned with whether the constitution had been tampered with or not.

He said: “If this money has been withdrawn and we know which tier of government it belongs, our concern will then be if whatever is being done is against that provision of the constitution or any other provision.”
The lawmakers, therefore, mandated the house committee on finance to study the issue and report back to the house within four weeks.

PRESS RELEASE BY HONOURABLE DOROTHY MATO PURSUANT TO A SUIT FILED AGAINST THE HONOURABLE SPEAKER YAKUBU DOGARA BY FIDELIS AHANGBA ANGWEH


The attention of Honourable Dorothy Kpentomun Mato, Member Representing Vandeikya/ Konshisha Federal Constituency has been drawn to a court process filed on the 31st of November 2017 filed by Mike Utsaha Esq a Barrister and Solicitor of the Supreme Court of Nigeria on behalf of his client a certain Fidelis Ahangba Angweh who claims to be a constituent of Honourable Mato's.
The said suit is said to be filed to correct an injustice; the failure to swear Honourable Dorothy Mato into the House of Representatives as directed by the Supreme Court of Nigeria which has resulted in the violation of the Fundamental Human Rights of the said Ahangba.

It is pertinent to set evidential background to clear the air on this matter.
Sometime in August 2017, the same legal practitioner, filed an action on the same subject matter and joined Honourable Mato as a party. Indeed, this legal action, served as part of the delay in the swearing of Honourable Mato as the Speaker was willing to allow all legal actions to be exhausted before he would administer the oath of office on her.


The timely, proactive and spontaneous reaction of Honourable Mato by drawing the attention of His Excellency the Governor of Benue State, Dr Samuel Ortom who quickly intervened and reached out to the lawyer, appealing to him to withdraw the matter which they did by filing a notice of discontinuance was what averted another long and arduous legal expedition. Copies of the notice of discontinuance were sent to the office of Honourable Mato which same was sent to the office of the Honourable Speaker and all members of the House of Representatives from Zones A and B of Benue State.


It would interest members of the public to know that in all of this, the said Ahangba never reached out, sought the opinion nor ever communicated with the Honourable Member in the course of filing this case. Honourable Mato neither knows nor has ever come in contact with the said Applicant. If indeed he was fighting her cause, why has he never bothered to reach out to her to know the true situation of the matter? Seeing that the entirety of this case is premised on her not being sworn in.


His current cause of action which doesn't join her as a party but yet, uses her matter to buttress his case reeks of mischief, double dealing and malice aforethought.


We are convinced beyond every shadow of doubt that the cause of action is premised on mischief for the fact that if Ahangba claims to be an aggrieved and deprived constituent, he ought to have kept himself abreast of the happenings and should have known that Honourable Dorothy Kpentomun Mato sworn in by the Honourable Speaker of the House of Representatives Rt Honourable Yakubu Dogara on the 3rd of October 2017 at 11:35 am, three weeks before the filing of his matter.


Ahangba makes his case suspicious because for him to claim to have heard from online sources that Honourable Dorothy Mato had twice presented herself for swearing in, but was unaware that she had presented herself and was sworn-in, can only be the workings of a mischievous and sinister person as the social media and electronic and print media were awash with the news of her being sworn in after so long.

One would expect an applicant with such grievances before a court to have his ears to the ground as regards the very soul and crux of his matter, yet Ahangba claims and feigns ignorance of this epic event.It is therefore necessary to make the following declarations;
1. That Honourable Dorothy Kpentomun Mato disassociates herself in totality from the suit and indeed any such suit in existence or anywhere else for that matter. Having endured the travails of litigation, she is neither interested in being roped into any flimsy, unnecessary, frivolous or mischievous litigation aimed at earning cheap publicity and political points.



2. That recently, Honourable Mato was a part of a delegation of Members of the House of Representatives from Benue to the President and Commander in chief of the Armed Forces of the Federal of Republic of Nigeria President Muhammadu Buhari GCFR to complain about the current crisis in Benue State resulting in numerous deaths and destruction of property on account of attacks on farming communities by suspected herdsmen. This visit was widely publicized, this gets one wondering if Ahangba lives under a rock as that would be only plausible reason he would claim to be unaware of this widely broadcasted event as she clearly stood out as the only woman and the one who read the speech on behalf of the group.


3. That Honourable Dorothy Mato has since settled into the House of Representatives and enjoys a good relationship with her colleagues and the tremendous goodwill of the Honourable Speaker who magnanimously ensured that she inherited all the committees previously held by the erstwhile ousted Member.
He further co-opted her to other committees as well and she since commenced carrying on her legislative duties as diligently as possible both in her committees and on the floor of the House of Representatives.If Ahangba is truly a constituent of the Vandeikya / Konshisha Federal Constituency, he should not be unaware of the giant strides taken by Honourable Mato since becoming a member of the House of Representatives only a few months ago, his supposed or deliberate ignorance fuels the suspicion of his identity as a constituent or the actor of a badly written script.



4. That Ahangba is crying more than the bereaved as the bereaved have since moved on, wiped their tears and come to terms with reality but Ahangba seems to either be oblivious of the current trend of events or is feigning ignorance to carry out the dictates of political detractors who are yet to come to terms with the fact that Honourable Dorothy Kpentomun Mato is a valid and bona-fide member of the House of Representatives.



5. That Honourable Dorothy Kpentomun Mato is focused on supporting and participating in the passage of good laws that will benefit her constituents and not interested in the distractions of frivolous court cases by faceless and overzealous constituents and no effort to distract or deter her from this laudable cause will be successful.

#BREAKING: Senate To Investigate Saraki and Melaye Over Alleged Fake Car Documents and Certificate Scandal



The senate committee on Ethics and Privileges is to investigate allegations level against the Senate President Dr. Bukola Saraki and Senator Dino Melaye of Kogi West.

The allegations of irregularities of car importation with fake duty level against Saraki and to also probe Dino Melaye over alleged certificate scandal.

Senator Ali Ndume, former Senate leader from Borno State where EFCC’s Ibrahim Magu hails from raise the issue and gave reference that leaders of the National Assembly previously like the former Speaker from Kano State, Salisu Buhari, Dimeji Bankole and Aminu Bello Masari, also the case of former senate president in the person of Adolphus Wabara and Evan Enwerem were all investigated when issues of similar case were brought up against them in the floor of the chamber.

The committee has four weeks to submit its reports.
Meanwhile, the Senate also sets up ad-hoc committee to investigate activities of Executive Secretary of the National Health Insurance Scheme the NHIS.

CHEATING THE SYSTEM: Lawmakers employ 2,570 aides then cheat the system.



No fewer than 2,570 aides are engaged by the 469 members of the 8th National Assembly, an investigation by the News Agency of Nigeria, NAN, has revealed.

Out of the number, 700 aides work for lawmakers in the Senate, while the remaining 1, 870 are engaged by House of Representatives members.

As provided in the National Assembly Act, each lawmaker, excluding principal officers, is entitled to five aides – one senior legislative aide, two legislative aides, a personal assistant and a secretary.

It was discovered that in the provision, President of the Senate is entitled to 45 aides, his deputy, 30, and 20 each for principal officers.

Similarly, Speaker of the House of Representatives has 35 assistants, Deputy Speaker, 15 and 10 each for the six principal officers.

The number of aides to each legislator, it was gathered, includes those in their Constituency offices.

The monthly emolument of the aides, which ranged from N150, 000 to N250, 000, sources close to the assembly said, has been reduced to between N75, 000 and N180, 000 by the current leadership of the assembly.

The investigation revealed that in addition to the regular aides, the principal officers of both chambers have Special Assistants, Senior Special Assistants and Special Advisers of varying numbers.

This category of aides, it was learnt, had a monthly salary of a minimum of N950,000; but was reduced to N400, 000 by the current management of the assembly. All the aides are paid from the coffers of the assembly.

CHEATING THE SYSTEM

However, NAN gathered that some of the lawmakers, especially principal officers, have more than the statutorily approved number of aides in their employ, who also draw their salary from the assembly’s funds.

Some lawmakers, however, pay the aides from their own resources.

It was also revealed that many legislators draw the emolument of their aides from the assembly’s funds but pay them fractions. Some of the lawmakers employed only one or two aides but are collecting the full salary for the five they are entitled to.

This act was discovered to be perpetrated more by the members through their constituency offices, which they are mandatorily expected to have in their areas, but deliberately failed to do so.

They submit names of non-existent staff in the constituency office to the national assembly service commission and collect their entitlements directly.

An aide to a senator from the South-West, working with him in Abuja, told NAN that he had never heard of other aides or office his boss had in his constituency.

“All of us, his aides are here; it is only when he is travelling to the state that he goes with the senior legislative aide and his younger brother.

“The brother works with him; he is not documented but he is in charge whenever oga (the boss) is not around.

“But, all of us are always in the office in Abuja, I do not know of assistant or aide he has at the constituency level or in the state,” he said, adding that it was the same with some other lawmakers.

The source declined to disclose his salary, allowance and pay point, but said that the emolument depended on the grade of the aide.

He, however, disclosed that the least-paid aide earned N120, 000 from the assembly commission.

The lawmakers contacted on the issue declined to comment, with some of them saying that they were complying with the rules.

The Clerk of the National Assembly and officials in his office also rebuffed enquires on the issues.

NIGERIANS REACT

Reacting to the findings by NAN, some stakeholders called for reduction in the number of aides working for federal lawmakers and a slash in their pay.

They told NAN that the reduction was necessary in view of the current economic challenges facing the country.

Ahmed Haruna, a trader in Wuse Market in Abuja said “from my own point of view, I think the number of aides assigned to legislators is much and consumes a huge amount from public funds.

“These aides are paid monthly but if their number is slashed and their pay reduced, the money can be redirected into providing infrastructure in the country.”

Paul Imohiosen, a civil servant, believes that the lawmakers do not need the number of aides they are officially entitled to.

He said, “some of these aides are not useful; most of them are there for mere decoration. They are just too many.

“The country’s economy has gone into recession so this is not the appropriate time to use as much as 45 or 35 aides by one government official.’’

Mr. Imohiosen also decried the number of security details attached to some government officials and other elite in the country.

According to him, Nigeria is in need of adequate security to protect lives and property but government officials have huge number of security aides all to themselves which is not fair.

In her view, Igoni Mirabel, a student, insisted that there was need to cut the number and salary, respectively, of the legislative aides by 50 per cent.

“The 50 per cent cut should serve as intervention and the remaining percentage could be used judiciously to improve the economy of the country.

“The Nigeria economy is in a bad state presently, so all expenses must be cut down so that the citizens can benefit immensely,” she added.

On her part, Imelda Omelogo said that the number of aides and their emoluments “does not suggest a prudent approach to the management of public expenditure.

“If the call for the reduction in number of aides to the lawmakers is implemented, it will greatly reduce wastage, thereby leaving more money to be ploughed into other sectors.’’

Condemning the large number of the federal lawmakers’ aides, Emmanuel Sawyer, a legal practitioner, said it did not tally with the economic hardship in the country.

He said the number of aides should have been slashed along with their salaries by the new leadership of the national assembly.

“We are in a period when Nigeria is facing recession and the cost of running government is still too high.

“At this point in time, we should be talking of merging both chambers into one to reduce the cost of running governance,” Mr. Sawyer said.

Teddy Nwanunobi, a civil servant, said that it was unfair for such big salaries to be paid to aides of lawmakers when they were not doing any work commensurate to the pay.

Mr. Nwanunobi questioned why some of the principal officers should be entitled to many aides.

“My honest thinking is that the principal officers do not need more than five aides to start with. That way, the aides would be up the task on their duties.

“Secondly, the nearly N1 million monthly salary is just too large for one aide; most of them do not merit that sum, and that’s why they misbehave.

“Personally, I suggest that aides should be graded, and salaries paid accordingly; their salaries should not only be slashed, but paid in accordance with grade and level,’’ he said.

Adanna Uwaleme, a political analyst, however said that the call for slash in the number of aides to the lawmakers should be extended to the Executive arm of government.

Ms. Uwaleme said most of the ministers, and even the President, have too many aides.

She said, however, that she was not suggesting that people be sacked but said that there was need to save cost.

“There is no need employing too many aides and paying them so much when other people who do so much work are paid very little.

“I feel that there should be a harmonisation of salaries and allowances of aides and staff of choice government agencies like the NNPC and FIRS with other federal workers.

“There is no justification for paying someone in NNPC so much salary while his colleague on the same level in the ministry takes less than quarter of his salary,” she said.

Emeka Ogwuru, a businessman, said that those on the payroll of the lawmakers were “just lucky; many other Nigerians would do anything to get the same position.

“Even if it’s N400,000 a month, at least they can afford a bag of rice, a basket of tomatoes, 50 litres of petrol and book a local flight online in this recession,” he said.

This was made known by Alhassan Doguwa, the Majority Whip of the House of Representatives, in a text message to The Punch.

According to Doguwa, Jibrin has lost his moral conscience and is fighting a lost battle with no single reasonable member behind him.

Doguwa’s reaction is a response to a letter written by Jibrin to all 360 members of the House.

Jibrin had charged fellow lawmakers in his letter to use Speaker Yakubu Dogara ‘as an example’ in war against corruption, because the padding scandal has become a global issue and ‘the world is watching’.

Abdulmumin Jibrin, the embattled former appropriations committee chairman, has been described as a psychiatric case who should be ignored.

But in response, Doguwa said: “It is now high time Nigerians and indeed our press disregarded and ignored any statement or communication coming from Abdulmumin Jibrin, the sacked Appropriation Committee Chairman.

“He has already lost moral conscience. He has now realised that he is fighting a lost battle with no single reasonable member behind him.

“We as a leadership have succeeded in consolidating our support base in the House, with over 300 respected members willingly signing the vote of confidence roll.”

Responding to a question on whether or not the issue will feature when the House resumes on Tuesday, September 20, Doguwa said: “When we resume on Tuesday, the House will not even waste its valuable time discussing Jibrin’s issue.

“We would rather continue with more important legislative issues that would impact positively on our economy and the people we represent.

“I, therefore, on behalf of the leadership of the House wish to call on all our well-meaning members to disregard the so called letters sent to them by Abdulmimin Jibrin, whom we have all condemned and believed has lost his common sense.

“He is just a psychiatric case that everyone must condemn. Members must remain focused and never allow themselves to get distracted by the nuisance Jibrin.”

Jibrin had in the letter dated September 16, 2016, demanded the resignation of the Speaker, Yakubu Dogara, the Deputy Speaker, Yusuf Lasun, the Chief Whip, Alhassan Doguwa and the Minority Leader, Leo Ogor.

He accused them of budget fraud, corruption and abuse of office among other allegations.

Buhari Presents Two Anti Corruption Bills To Senate For Amendment.



As his campaign against corruption continues, President Buhari yesterday sent a letter to the Senate asking for the amendment of two bills that will advance his fight against corruption. The bills are the Money Laundering Prevention and Prohibition Bill 2016 and the Mutual Legal Assistance in Criminal Matters Bill 2016.

This is a  new twist to the alleged missing 2016 budget, the Senate President Bukola Saraki this afternoon on his Facebook page, stated that the senate received two versions of the 2016 budget, one from President Buhari and another from the Senior Special Assistant to the President on National Assembly Matters (Senate), Ita Enang and that they will only be using the one presented to the National Assembly by Buhari on December 22nd.
